Passenger Transport and Service Agreement

1. Parties
   1.1. Service Provider:

1.2. Passenger / Customer:
The individual or corporate customer who makes a reservation through turkatours.com or on whose behalf a reservation is made.

turkatours.com and the Passenger/Customer are hereinafter individually referred to as a “Party” and jointly as the “Parties”.

1. Subject and Scope
   This Agreement regulates the terms and conditions applicable to the passenger transport (transfer) services provided by turkatours.com within the borders of the Republic of Türkiye. No international transfer service is provided.
2. Definitions

• Reservation: The confirmed booking of a transfer service made by the Passenger through turkatours.com or via authorised representatives.
• Transfer: The carriage of the Passenger between the specified start and destination points by vehicles operated by turkatours.com.
• Vehicle Types (for information): Mercedes-Benz Maybach, Sprinter, Vito, and Standard Transporter class vehicles. Vehicle allocation is made according to passenger count, luggage capacity, and operational suitability.
• Dynamic Pricing: Pricing determined instantly based on distance, route, date, time, and operational conditions.

1. Formation of the Agreement
   The Agreement is deemed concluded when the Passenger completes an online reservation on turkatours.com and provides the required travel details. By proceeding with the booking, the Passenger accepts all terms stated herein.
2. Fees and Billing
   All transfer prices are dynamic and calculated at the time of booking. Prices shown on the website are inclusive of taxes. Invoices are issued in compliance with Turkish tax legislation (VUK).
3. Payment Methods
   Payment may be made directly to the driver in cash or via POS (if available), or online by debit/credit card, Apple Pay or Android Pay (subject to availability). Refund periods may vary depending on the card type and bank.
4. Reservation, Cancellation, and No-Show Policy
   7.1. Changes and cancellations must be made through turkatours.com communication channels.
   7.2. Once the aircraft has landed, cancellation is not possible.
   7.3. If the Passenger fails to appear within two (2) hours after the actual landing time, the service is terminated and no refund will be made (no-show).
   7.4. For non-airport pickups, the maximum waiting period is fifteen (15) minutes. Further delays may incur additional charges or be deemed no-show.
   7.5. turkatours.com reserves the right to change vehicles or drivers when necessary for operational or safety reasons.
5. Vehicles, Drivers, and Safety
   All vehicles are covered by comprehensive insurance, traffic insurance, and personal seat accident insurance. Drivers operate in compliance with road traffic laws. Seat belts are mandatory for all passengers. Requests for child or baby seats must be made at the time of booking and may incur an additional charge.
6. Passenger Obligations
   The Passenger must provide accurate identification or booking details upon request, wear a seat belt, comply with safety instructions, and behave respectfully within the vehicle.
   Luggage limits are subject to reasonable capacity; dangerous, flammable, or illegal materials are strictly prohibited. Route or stop changes require prior approval and may result in extra charges.
7. Lost Property
   turkatours.com shall not be held responsible for items left inside vehicles. If found, items can be collected from the designated office or shipped to the Passenger at cost.
8. Limitation of Liability
   turkatours.com shall not be liable for indirect or consequential losses such as missed flights, lost profits, or delays caused by traffic, weather, or public restrictions. Liability arising from insurance coverage and mandatory legal provisions remains reserved.
9. Personal Data (KVKK)
   Personal data required for providing the service shall be processed in accordance with Turkish Law No. 6698 on the Protection of Personal Data (KVKK).
   Passengers consent to communication by SMS, e-mail, or phone for reservation and operational purposes.
10. Force Majeure
    turkatours.com shall not be liable for failure to perform its obligations due to force majeure events such as natural disasters, adverse weather, war, strikes, official restrictions, or unforeseen traffic disruptions.
11. Assignment
    The Passenger may not transfer any rights or obligations under this Agreement to a third party without the written consent of turkatours.com.
12. Governing Law and Jurisdiction
    This Agreement is governed by the laws of the Republic of Türkiye.
    In case of dispute, the Courts and Enforcement Offices of Istanbul (Çağlayan) shall have exclusive jurisdiction.
    Consumer passengers retain their statutory rights to apply to the Consumer Arbitration Board or Consumer Court.
13. Effective Date and Amendments
    This Agreement enters into force upon publication on turkatours.com.
    turkatours.com reserves the right to amend this Agreement in line with legal or operational changes. The latest version published on the website applies to all new reservations.
